![]() ![]() ![]() I sent a message on FB, they stated I could mail in a response or used the secure message system online, so I sent it throught the secured portal. It's from July 2019 30 days, I missed June's payment then paid the end of July. The person in front or him was over ten grand in debt to them, and we only used $150 of our credit card.I have one missed payment on my report and my score took a major hit. My husband said there were probably 10 different people there that capital one was suing. My point is that as incredibly insane as it sounds, companies will 100% sue over this stuff. ![]() They decided we make enough money to pay it and we are now on a payment plan. He had to go to court this week to go over either a settlement or a payment plan. We never received anything about a court date to begin with but the clerk magistrate said that unless the mail was returned to them because of a wrong address, it didn't matter. ![]() With the late fees and court fees that were tacked one, they were awarded just over $600. We got a letter from the courthouse in December saying that he missed the court date with the judge to fight this and so we were ordered to pay them. The limit on it was $300 and we probably used maybe $150 of it and I got laid off and then pregnant and had the baby extremely prematurely and we totally forgot. But my husband was literally in court this past Wednesday over an old Capital One credit card that we forgot about. It could just be their way of trying to get more money from you. Will they really take legal action for like $300 that I paid and have bank records showing payment? I am currently a stay at home mom (unmarried) so I dont have any income myself. I need help I don't really know what to do here. I don't have a recording of that call, but I guess they should. At the time we made that agreement I specifically asked if my account would be closed and if I would owe more intrest each month and I was told NO I wouldn't because I was just paying off the balance of the closed account. I don't know what to do, because I made an agreement with them and I paid what they asked. I haven't received anything in the mail indicating legal action, just what they've threatened in voicemails. I decided this was BS and not to deal with it, but now they are calling me saying I need to get an attorney. But they have still been harassing me with phone calls and one person I actually spoke with said that they never closed my account and I stilled owed them interest from those payments I made? The payments came out of my bank account as scheduled and I thought I was done with them. They said it wouldn't incur any more interest and my account was closed. Last April I called them to settle the debt, and they told me an amount I could settle the account for, and they said I could split that amount into 3 payments. I only spent $100 on it, but with interest and forgetting to pay it, it went up to about $300. I was young and stupid and opened a Victoria Secret card.
